2. Scope
This notice describes how Blackruby Technologies processes personal data received in connection with business enquiries and with expressions of interest in employment, and states what personal data this website collects.
3. Personal data processed
Business enquiries
Where an individual contacts Blackruby Technologies by electronic mail or by telephone, we process the personal data contained in that communication. This ordinarily comprises name, employing organisation, electronic mail address, telephone number where provided, and the content of the communication.
Expressions of interest in employment
Where an individual writes to careers@blackrubytechnologies.com, we process the personal data contained in that communication and in any attachment, ordinarily comprising name, contact details, curriculum vitae or equivalent career information, and any further information the individual elects to provide.
Website use
This website does not set cookies, does not employ analytics, and issues no requests to third-party services. Typefaces are served from our own domain. No tracking of visitors is undertaken, whether within this website or across others, and no visitor profile is created. Standard server logs are retained by our hosting provider in the ordinary course of technical operation and are not used to identify individuals.
Blackruby Technologies does not purchase personal data. Where an application is being progressed, we may obtain personal data from referees nominated by the applicant.
4. Purposes and lawful bases
Responding to business enquiries
Answering the enquiry made and, where applicable, discussing whether Blackruby Technologies is able to assist. Lawful basis: legitimate interests.
Discussing a prospective engagement
Scoping work, preparing proposals and agreeing terms. Lawful basis: steps prior to entering into a contract.
Assessing expressions of interest
Determining whether an individual's experience corresponds to an opportunity arising presently. Lawful basis: legitimate interests.
Retaining details for future opportunities
Where an individual has expressly asked us to do so, retaining and considering their details for relevant future opportunities for up to twelve months. Lawful basis: consent.
Progressing a specific application
Arranging interviews, obtaining references and making offers of employment. Lawful basis: steps prior to entering into a contract.
Compliance
Retaining or producing records where required by law. Lawful basis: legal obligation.
Where Blackruby Technologies relies on legitimate interests, it has assessed whether those interests are overridden by the interests, rights and freedoms of the individual concerned and has concluded that they are not, on the basis that the individual has initiated contact and the personal data is processed solely for the purpose for which it was provided. Further information concerning that assessment may be requested, and an objection may be made, at info@blackrubytechnologies.com.
Personal data is not processed for marketing purposes. No automated decision-making, including profiling, is carried out.
5. Recipients
We do not disclose recruitment or enquiry information to recruitment agencies, consultants or other organisations for their own purposes. Service providers acting on our behalf may process personal data where necessary to provide their service.
Electronic mail services are provided by Namecheap, which acts as a processor on behalf of Blackruby Technologies.
Personal data may be disclosed where disclosure is required by law.
6. International transfers
Blackruby Technologies is established in the United Kingdom, and personal data received from individuals in Nigeria is transferred outside Nigeria in the course of being received and assessed. Authorised employees of BLACKRUBY TECHNOLOGIES LIMITED located in Nigeria may access that information remotely.
Under the Nigeria Data Protection Act 2023, where an application or expression of interest is sent to Blackruby Technologies from Nigeria, the transfer is made under section 43(1)(b), because it is necessary in order to take steps at the request of the individual prior to entering into an employment contract.
Where an individual separately asks us to retain their details for future opportunities, that continued retention is optional and is based on their consent, as described in section 7.
Access by employees of BLACKRUBY TECHNOLOGIES LIMITED located outside the United Kingdom is access by the controller's own personnel and does not constitute a transfer to a separate organisation for the purposes of the United Kingdom General Data Protection Regulation.
7. Retention
Business enquiries are retained for two years from the date of last contact, following which they are deleted. Where an enquiry results in a client relationship, records are retained for the duration of that relationship and thereafter for such period as legal, regulatory and accounting obligations require.
Applications and expressions of interest are retained for as long as necessary to consider the individual for the opportunity to which their communication relates, following which they are deleted.
Where an individual has expressly consented to their details being retained for future opportunities, those details are retained for twelve months from the date of receipt and are then deleted. Consent may be withdrawn at any time by writing to careers@blackrubytechnologies.com, and the details are then deleted. Withholding or withdrawing that consent has no effect on consideration for any opportunity already under discussion.
Deletion is carried out by the person responsible for data protection.
8. Rights of individuals
Depending on the circumstances, individuals may have rights including the right to be informed of the personal data held concerning them and to obtain a copy; to obtain rectification of inaccurate personal data; to obtain erasure of personal data which is no longer necessary for the purposes for which it was collected; to obtain restriction of processing pending resolution of a query; to object to processing carried out in reliance on legitimate interests; to withdraw consent where processing is based on consent; and, where processing is automated and based on consent or on a contract, to receive personal data provided to Blackruby Technologies in a structured, commonly used and machine-readable format.
Requests should be addressed to info@blackrubytechnologies.com. We will respond without undue delay and normally within one month, subject to any extensions or other provisions permitted by applicable data-protection law. Requests are ordinarily handled free of charge, although a reasonable fee may be charged where the law permits.
9. Complaints
Complaints concerning the processing of personal data by Blackruby Technologies should in the first instance be addressed to info@blackrubytechnologies.com.
An individual who remains dissatisfied is entitled to lodge a complaint with a supervisory authority. In the United Kingdom, the Information Commissioner's Office (ico.org.uk). In Nigeria, the Nigeria Data Protection Commission (ndpc.gov.ng).
10. Amendment
This notice will be amended where processing practices change. The date stated at the head of this notice indicates when it was last revised.
